– Orders valued at €200 and above are delivered free of charge, provided the delivery is to a ground floor location with unobstructed access.
– For deliveries above ground floor, the customer must arrange a lifter service at their own expense, paid directly to the lifter operator.
– In the event that a lifter cannot be used due to site restrictions, The Casa Collection Ltd reserves the right to either:
– Unsafe or hazardous delivery conditions (e.g., construction sites, narrow access, structural risks) may result in immediate suspension or refusal of delivery by our team.
– Clients must ensure availability at the scheduled appointment time. A no-show incurs a €100 penalty. Late arrivals over 30 minutes incur a €40 fee.
– Delivery appointments can be rescheduled free of charge if we are informed at least one working day in advance via phone or email.
Where requested, our team may perform installations involving wall fixtures, drilling, and setup within customer premises:
– The Casa Collection Ltd is not liable for any damage resulting from wall or tile weaknesses, uneven surfaces, incorrect structural alignment, or latent defects within the installation area.
– Customers must ensure that the property is structurally fit for installation (e.g., concrete walls, proper backing support). We do not perform structural assessments.
– We disclaim all responsibility for damages that occur in stairwells, elevators, corridors, or common areas of buildings during the course of delivery or installation.
– Customers are advised to protect flooring, walls, and fragile surfaces in advance of delivery.
– Post-installation complications (e.g., falling fixtures, tile cracks) that arise from the inherent condition of the walls or client tampering are not covered under our responsibility.
Returns and cancellations are governed by EU and Maltese consumer law. Our terms aim to balance consumer rights with protection against misuse:
– Under EU Directive 2011/83, online purchases may be cancelled within 14 days unless they fall under exemptions.
– Custom-made or personalised products are non-cancellable and non-refundable under Article 16(c) of the Directive.
– Standard (stock) items can be cancelled without charge up to 3 full business days before the confirmed delivery or collection date.
– After this window, cancellations are not guaranteed and may incur administrative and logistics fees.

– We will store fully paid or deposit-held goods free of charge for up to 1 calendar month from the order date.
– After 1 month, storage fees apply at €50 per item, per month.
– Storage fees are capped at 3 months. If goods are not collected or balance not paid in full after 3 months:
– Continued holding beyond 3 months may be arranged only via a private agreement with additional fees.
– Goods will not be released until all outstanding balances, including storage fees, are paid in full.
The Casa Collection Ltd shall not be held liable for any indirect, incidental, or consequential loss, including but not limited to:
– Loss of enjoyment, time, or convenience;
– Property damage caused by improper installation by third parties;
– Structural misalignments, unlevel flooring, wall defects, or installation failures due to customer-provided conditions;
– Delivery delays caused by force majeure events including but not limited to strikes, weather events, or supplier delays;
– Use or misuse of products once delivered and installed.
Liability is limited to the value of the product purchased.
These terms and any transaction carried out with The Casa Collection Ltd shall be governed by the laws of Malta and applicable EU regulations.
– Disputes arising from contracts, service delivery, or product issues should first be addressed by contacting us directly.
– If unresolved, customers may escalate the matter to the Malta Consumer Claims Tribunal or pursue action in the competent Maltese courts.
– We are committed to resolving disputes amicably where possible.
Some products listed online may be marked as ‘Available on Back Order’. This means:
– The product is not currently in stock but may be ordered specifically for the customer.
– Upon receiving such an order, we will review availability and contact the customer using the contact information provided to:
– Only upon mutual agreement between both parties regarding ETA and product availability will the order be confirmed.
– A binding sales contract is only formed once The Casa Collection Ltd issues an official Sales Order Confirmation.
– Orders submitted online without confirmation are considered non-binding until acknowledged by our team.
